United in Heart Privacy Policy

Introduction

This Privacy Policy outlines United in Heart ("we", "our" or "the Nonprofit") practices with respect to information collected from users who access our website at https://unitedinheart.org  (the “Website”) or our United in Heart app (the “App”) (collectively the "Site" or “Services”), wherein such people are collectively referred to as “you” and "Users". 

This Privacy Policy is a part of the Terms of Use and is incorporated therein by reference.

We encourage Users to carefully read the Privacy Policy and use it to make informed decisions.

Privacy Principles

United in Heart has two fundamental principles when it comes to personal information:

  1. We don't sell your personal information or use it to show you ads.

  2. We only store the personal information that we need to operate our Services so you can find the people you choose, be found by others, and empower personal initiative around environmentalism, social activism, and self empowerment.

This Policy applies to anyone who accesses the Service. By visiting the Website and/or using the App or Service, you acknowledge that the collection, use, and sharing of your information will take place as described in this Policy.

What happens to Personal Information we receive in the Goals section?

In the United in Heart app, there are three Goals pages:  diet, carbon and communication.  In general, we will only use the Personal Information with trusted third party providers to help with specific needs in carrying out our app.  For instance, we store data in Google Firebase.  These service providers need access to your information in order to carry out their work.  For more information, please see the “You hereby consent to us using the information for the following:” section in this Privacy Policy.

At an anonymized level, we use goals information to assess and carry out our organizational needs and responsibilities. 

What Information we collect?

We collect two types of data and information from Users who register or participate in our website unitedinheart.org or our United in Heart app.

The first type of information is individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual (“Personal Information”).  Such information includes:

  • Registration information: When you register in our website or our app, you will be asked to provide us certain details such as:  full name; e-mail address, goals, activities (such as your carbon emission reduction activities), invitees, invitor, contacts, and other information, as further described in our Terms of Use/registration form/goals pages.

  • Payment Information: In order for you to donate money, you may be required to share personal information within the Site or with our trusted payment processor. Such personal information may include your name, billing address, contact information, financial information (e.g. your credit card number, bank account, etc.) and any other information which is required in order to complete your transaction.

The second type of information is un-identified and non-identifiable information pertaining to a User(s), which may be made available or gathered via your use of the Site (“Non-personal Information”), even if you do not participate or register with us.  We are not aware of the identity of a User from which the Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. Wi-Fi usage, browser type, language preference, access time, etc.) in order to enhance the functionality of our Site. We may also collect information on your activity on the Site (e.g. search queries, clicks, actions, etc.).

How is the information used? With whom do we share the information?

We never rent or sell Users’ Personal Information to third parties. 

We do not share Users’ Personal Information with third parties except as described in this Privacy Policy.  For instance, see the next section on what you consent us to do.

You hereby consent to us using the information for the following:

  • Allowing other users to view your full name, location and avatar (the photo you upload in the Settings screen) in order to:

    • enable invitees to pick their invitor;

    • enable friends to reach out to other friends;

    • enable other communication among and between United in Heart Users;

  • Setting up a User's account;

  • Verifying your identity;

  • Communicating with you – sending you notices regarding new features of the App, providing you with technical information, support, and responding to any customer service issue you may have;

  • Determining your eligibility to redeem Enviros;

  • Collecting and saving viewing history and other interactions / user clicks on the App;

  • Marketing and advertising by United in Heart;

  • Send marketing emails to you that promote the use of United in Heart from which you can opt-out;

  • Conducting statistical and analytical purposes, intended to improve the Site.

Our marketing emails tell you how to opt-out or unsubscribe. If you opt-out of marketing emails, we may still send you non-marketing emails and notifications, which may include information about your account, our business dealings with you, and updates regarding our policies.

In addition to the different uses listed above, we may transfer or disclose Personal Information to our employees, subcontractors and agents to carry out our Services on the condition that such recipients do not further share this information with third parties.

In addition to the purposes listed in this Privacy Policy, we may share Personal Information with our trusted third party providers, who may be located in different jurisdictions across the world, for any of the following purposes:

  • Providing you with our service, including providing a personalized display of our Site;

  • Storing and processing such information on our behalf;

  • Performing research, technical diagnostics or analytics on our behalf related to our organizational goals and services;  

We do use a number of service providers for some of our specific needs such as playing videos, sending email, and gathering statistics about which videos are being watched. These service providers need access to your information in order to carry out their work. We may also disclose information if we have good faith to believe that disclosure of such information is helpful or reasonably necessary to: (i) comply with any applicable law, regulation, legal process or governmental request; (ii) enforce our policies (including our Agreement), including investigations of potential violations thereof; (iii) investigate, detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues; (iv) to establish or exercise our rights to defend against legal claims; (v) prevent harm to the rights, property or safety of us, our users, yourself or any third party; or (vi) for the purpose of collaborating with law enforcement agencies and/or in case we find it necessary in order to enforce intellectual property or other legal rights.

Affiliated Nonprofit Organizations and Other Third Parties

Unless specifically authorized in the “You hereby consent to us using the information for the following:” section above, nothing in this Privacy Policy or the Terms of Use agreement authorizes us to share your Personal Information with an affiliated nonprofit organization or any other third party.

User Rights, including California Consumer Privacy Act (CCPA) and General Data Protection Regulation (GDPR)

The CCPA and GDPR provides rights to certain individuals located in California and the European Union. We apply these rights to all of our users. You can contact us about these rights at help@unitedinheart.org.

CCPA

We do not disclose Personal Information beyond what is described in this Policy. All our users, including those in California, have the following rights.

  • Right to access: You have the right to know and see what data we have collected about you over the past 12 months including:

    • categories of personal information we have collected about you;

    • categories of sources from which the personal information is collected;

    • the business or commercial purpose for collecting your personal information;

    • the categories of third parties with whom we have shared your personal information; and

    • the specific pieces of personal information we have collected about you.

  • Right to deletion: You have the right to request that we delete in certain circumstances the personal information we have collected from you.

  • Right not to be discriminated against: You have the right not to be discriminated against for exercising any of these rights.

European Union General Data Protection Regulation (GDPR)

We, United in Heart, are the data controller of your Personal Information.

Information according to GDPR Article 27

United in Heart is a non-profit organization located outside of the European Union.  Nonetheless, all our users, including those in the European Economic Area (EEA), have the following rights, about which you can contact us at help@unitedinheart.org.

You may:

a. permanently delete all of your Personal Information on the App and we will accordingly permanently delete your account and all of your Personal Information from our system.  However, if you made a donation through the United in Heart app, then we may keep a record of it.

b. view all of your Personal Information you entered in the App by viewing the goals, resources, food forest payment, and settings pages of the App.

c. correct or update all of your Personal Information you entered in the App.

d. request whether or not Personal Information concerning you is being processed in any way other than for the ongoing servicing, maintenance or development of the App and, if so, how such Personal Information is being used.

e. Lodge a complaint.

However, please note that these rights (“a.”- “e.”) are not absolute, and may be subject to our own legitimate interests and regulatory requirements. 

Retention

We will retain your personal information for as long as necessary to provide our services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our policies. Retention periods will be determined taking into account the type of information that is collected and the purpose for which it is collected, bearing in mind the requirements applicable to the situation and the need to destroy outdated, unused information at the earliest reasonable time. Under applicable regulations, we will keep records containing client personal data, account opening documents, communications and anything else as required by applicable laws and regulations.

We may rectify, replenish or remove incomplete or inaccurate information, at any time and at our own discretion.  However, we may not and will not rectify or replenish your Personal Information if you deleted such information through the App.  Such deletion is permanent and unretrievable once the deletion is complete.

Cookies

When you use our Site, we may store cookies on your computer (as well as other tracking technologies like web beacons, pixels etc.) in order to facilitate and customize your use of our Site. A cookie is a small data text file, which a website stores on your computer's hard drive (if your web browser permits) that can later be retrieved to identify you to us. Our cookies may store information regarding your user account information. You are always free to decline our cookies if your browser permits, but such disabling may cause some of the features of our Site to not operate properly and your online experience may be limited.

We also use a tool called “Google Analytics” to collect information about your use of the Site. Google Analytics collects information such as how often users access the Site, what pages they visit when they do so, etc. We use the information we get from Google Analytics only to improve our Site and services. Google Analytics collects the IP address assigned to you on the date you visit sites, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to this Site is restricted by the Google Analytics Terms of Use  and the  Google Privacy Policy.

Third party collection of information

Our policy only addresses the use and disclosure of information we collect from you. To the extent you disclose your information to other parties or sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Accordingly, we encourage you to read the terms and conditions and privacy policy of each third party that you choose to disclose information to.

This Privacy Policy does not apply to the practices of companies that we do not own or control, or to individuals whom we do not employ or manage, including any of the third parties which we may disclose information as set forth in this Privacy Policy.

Minors

We encourage minors to review the terms of this Privacy Policy and the Terms of Use with their legal guardian.

Our Commitment towards Children's Privacy

We do not direct the Service to, nor do we knowingly collect any Personal Information from children under 13. Children under 13 are not eligible to use the Service. If we learn that a user is under 13 years of age, we will take steps to remove that user's Personal Information from our databases and to prevent that user from utilizing the Service.

How do we safeguard your information?

We take great care in implementing and maintaining the security of the Site and your information.

Your personal information is contained behind secured networks. We implement security measures when you enter or access your information, to ensure its safety. United in Heart maintains physical, electronic, and procedural safeguards that comply with applicable laws and regulations to protect your personal information.

Although we take reasonable steps to safeguard information, we cannot be responsible for the acts of those who gain unauthorized access or abuse our Site, and we make no warranty, express, implied or otherwise, that we will prevent such access.

Corporate transaction

United in Heart is a 501c3 nonprofit and in no way foresees the sale of its assets or its organization.  Nonetheless, in the unlikely event of a corporate transaction (e.g. sale of a substantial part of our business, merger, consolidation or asset sale) we may share information. In the event of the above, the transferee or acquiring company will assume the rights and obligations as described in this Privacy Policy.

Updates or amendments to this Privacy Policy

We reserve the right, at our sole discretion, to modify or replace these Privacy Policy terms at any time. We will do our best to notify you in advance of any major changes.

Your continued use of the Site, following the notification of such amendments on our website, constitutes your acknowledgment and consent of such amendments to the Privacy Policy and your agreement to be bound by the terms of such amendments.
